Welcome to Easy Employee Reviews. These Terms and Conditions ("Terms") govern your access to and use of our employee performance review platform available at easyemployeereviews.com (the "Service"), operated by Easy Employee Reviews ("we," "our," or "us").

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must not access or use the Service.

2. Account Registration and Security

2.1 Account Creation

To use the Service, you must create an account by providing accurate, current, and complete information, including your name, email address, and company information. You are responsible for maintaining the accuracy of your account information.

2.2 Access Codes

Our Service uses access code-based authentication. You are responsible for:

  • Safeguarding your access codes and keeping them confidential
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use or security breach
  • Ensuring that your access codes are not shared with unauthorized individuals

2.3 Account Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use the Service. By creating an account, you represent and warrant that you meet these requirements.

3. Service Description

Easy Employee Reviews provides a cloud-based employee performance review platform that enables organizations to:

  • Conduct comprehensive performance reviews with customizable metrics
  • Track employee morale and gather feedback
  • Manage team members with role-based access (managers, assistant managers, employees)
  • Store and access historical performance data
  • Generate performance grades and analytics
  • Schedule and automate review cycles

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

4. Subscription and Payment Terms

4.1 Subscription Plans

We offer a Professional Plan subscription at $19 per month. New accounts receive a 14-day free trial period. No credit card is required to start the trial.

4.2 Free Trial

During the free trial period, you have full access to all features of the Service. If you do not upgrade to a paid subscription before the trial ends, your account will be suspended and data access will be restricted.

4.3 Billing and Payments

  • Subscription fees are billed monthly in advance
  • Payments are processed securely through Stripe, our third-party payment processor
  • By providing payment information, you authorize us to charge the applicable fees
  • All fees are non-refundable except as required by law
  • Prices are subject to change with 30 days' notice

4.4 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to the Service until the end of your current billing period. No refunds will be provided for partial billing periods.

5. User Obligations and Acceptable Use

5.1 Permitted Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for all content and data you input, upload, or transmit through the Service.

5.2 Prohibited Activities

You agree NOT to:

  • Violate any applicable laws, regulations, or third-party rights
  • Use the Service for any fraudulent, abusive, or unlawful purpose
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Introduce viruses, malware, or other harmful code
  • Reverse engineer, decompile, or disassemble any aspect of the Service

  • Use automated systems (bots, scrapers) without our written permission

  • Use the Service for the benefit of third parties
  • Frame or mirror any content from the Service

8. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the Service will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy, reliability, or completeness of content
  • Warranties that defects will be corrected

We do not warrant that the Service will meet your requirements or that any errors will be corrected. You use the Service at your own risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EASY EMPLOYEE REVIEWS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Service interruptions or data loss
  • Unauthorized access to or alteration of your data
  • Statements or conduct of third parties using the Service

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless Easy Employee Reviews and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of third parties
  • Your Data and content you submit

11. Termination

11.1 Termination by You

You may terminate your account at any time by canceling your subscription through your account settings or by contacting us.

11.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if you:

  • Violate these Terms
  • Fail to pay subscription fees
  • Engage in fraudulent or illegal activities
  • Pose a security risk to the Service or other users

11.3 Effect of Termination

Upon termination, your right to use the Service will cease immediately. We may delete Your Data after a reasonable period, unless we are required to retain it by law. Provisions that should survive termination (including warranty disclaimers, limitations of liability, and dispute resolution) will remain in effect.

12. Dispute Resolution and Governing Law

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Easy Employee Reviews operates, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any disputes arising from or relating to these Terms or the Service shall be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration in accordance with the rules of a mutually agreed arbitration service, or through courts of competent jurisdiction.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Easy Employee Reviews regarding the Service.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
